Transaction Terms & Conditions

By proceeding with a transaction on this website you agree to be bound by the following terms and conditions:

1. Interpretation

1.1 In this Agreement ‘KUSKEY'S BUTCHER SHOPPE' means KUSKEY'S BUTCHER SHOPPE.

1.2 Customer or you means the customer placing this purchase order with KUSKEY'S BUTCHER SHOPPE.

1.3 Goods means the goods ordered by you from KUSKEY'S BUTCHER SHOPPE.

1.4 This Contract shall be governed and construed in accordance with the laws in force in the State of Queensland and the parties submit to the non-exclusive jurisdiction of the Courts of Queensland.

2. Agreement Between Parties

2.1 Upon ordering goods from KUSKEY'S BUTCHER SHOPPE you hereby agree to be bound by these Terms & Conditions and a binding Contract is created between you and KUSKEY'S BUTCHER SHOPPE upon such order being placed.

2.2 These terms and conditions contain the whole Agreement between the parties unless KUSKEY'S BUTCHER SHOPPE and the customer agree in writing that any other correspondence, discussions or documents shall form part of this agreement and the parties agree that all warranties implied under statute or the common law will not operate upon this Agreement.

3. Obligations of KUSKEY'S BUTCHER SHOPPE

3.1 KUSKEY'S BUTCHER SHOPPE must: -(i) pending payment and subject to Clause 4 of this Agreement, deliver the goods ordered by the customer to the customer's delivery address within a reasonable time;(ii) ensure the goods are free from defects and that the goods perform their intended function.

3.2 A failure by KUSKEY'S BUTCHER SHOPPE to perform those obligations mentioned in Clause 3.1 of this Contract does not give the customer a right or cause of action at law against KUSKEY'S BUTCHER SHOPPE or a right to terminate this Contract.

4. Your Obligations

4.1 It is a condition of this Agreement that payment be made by you in respect of goods ordered from KUSKEY'S BUTCHER SHOPPE and proper payment details provided by you before proceeding with this transaction.

4.2 You acknowledge that KUSKEY'S BUTCHER SHOPPE reserves the right to refuse any order where it is apparent to KUSKEY'S BUTCHER SHOPPE that payment details provided by you are incorrect, improper or the subject of fraud.

4.3 You acknowledge payment is a condition precedent to shipment and KUSKEY'S BUTCHER SHOPPE reserves the right to refuse any order where it is apparent that payment of goods ordered by you cannot or is unable to be processed.

4.4 Notwithstanding Clauses 4.1, 4.2 & 4.3 KUSKEY'S BUTCHER SHOPPE reserves the right to render tax invoice/s in respect of goods ordered by you in circumstances it so chooses and you hereby agree to pay any tax invoice rendered by KUSKEY'S BUTCHER SHOPPE by the due date for payment specified on the tax invoice.

4.5 If any tax invoice is not paid by the due date for payment KUSKEY'S BUTCHER SHOPPE shall be entitled to charge interest on such amount as is outstanding from time to time at the rate of 1.5% per month.

4.6 Notwithstanding Clauses 4.4 & 4.5 the customer acknowledges it will remain liable to KUSKEY'S BUTCHER SHOPPE for the total price of the goods whether or not the goods have been shipped, delivered or a tax invoice rendered in respect of the goods so ordered.

5. Delivery

5.1 Upon receipt of payment by KUSKEY'S BUTCHER SHOPPE risk in the goods passes to the customer unconditionally, whether or not the goods are specific, ascertained, unascertained or future goods at the time risk is deemed to pass.

5.2 In addition to but without limiting Clause 3 of this Contract the customer hereby agrees KUSKEY'S BUTCHER SHOPPE will not be liable in any way, whether in any action in contract, negligence or other tortious action, arising out or as a result of damaged goods or delayed delivery reasonably related to any matter connected with shipment of the goods by KUSKEY'S BUTCHER SHOPPE to the customer.

5.3 The customer agrees to pay KUSKEY'S BUTCHER SHOPPE for all shipping and freight costs associated with delivery of the goods to the customer.

6. Variation

6.1 You hereby acknowledge upon receipt of any order placed by you, KUSKEY'S BUTCHER SHOPPE reserves the right to alter the character of the goods ordered prior to delivery as might reasonably be necessary taking into account the availability of the goods or any other matter beyond KUSKEY'S BUTCHER SHOPPE's control.

7. Shipping and Delivery Policy

7.1 We deliver products to the Bundaberg area via our own delivery drivers.

7.2 Exact shipping costs are calculated before delivery when payment is requested, and this fee will be communicated to you before payment is made. You can choose to pay for your order before delivery via phone, or you can pay the delivery driver upon receipt of your order.

8. Pricing Policy

8.1 All of our prices are in Australian dollars (AUD) and include GST (goods and services tax) as of 12 November 2021.

8.2 Product prices are regularly updated when price changes are received from our suppliers.

9. Customer Service Policy

9.1 KUSKEY'S BUTCHER SHOPPE is committed to providing exceptional customer service and quality products.

9.2 In the event that an ordered item is not available or we are unable to fulfill your order we will notify you as soon as we have knowledge of this, to arrange an agreeable alternative item, a backorder or a full refund.

10. Refund/Return Policy

10.1 Please choose carefully. We do not give refunds if you simply change your mind or make a wrong decision.

10.2 You can choose between exchange or refund where goods are faulty have been wrongly described, or are different to the product purchased on the website.

10.3 KUSKEY'S BUTCHER SHOPPE will not be responsible for, or refund any freight charges to or from a customer for any return parts regardless of reason for return.

12. Privacy policy

12.1 KUSKEY'S BUTCHER SHOPPE is dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured.

12.2 We do not pass on, sell or swap any of your personal details with anyone. We use this information to identify your orders, provide you with newsletters and to personalise your shopping experience with us.

13. Security Policy

13.1 When purchasing from KUSKEY'S BUTCHER SHOPPE your financial details are passed through Shopify and Shopify Payments using the latest encryption technology. If you have any questions please contact us.
